Vodafone case - Will the judgement tranform the tax structure for foreign investors?

A prelude to the vodafone case is attacehed in the word doc. This topic is open to all and active participation will help us develop our knowledge in a very varied field. Its a complex case whose outcome is keenly awaited by many foreign investors. For me the decision would really tranform the way cross border mergers and acquitions will happen. The judgement will definitely transform the tax structure for foreign investors because it plans to over ride the DTAA rule. And foreseeing that the FII's have started withdrawing which is so clear and the evident for the market collapse and many other global issues followed. But this has initially started devaluaing our Rupee. Even though the GAAR is not implemented now, FII might fear that next year it will affect anyways so better remove the investments. the change in tax structure doesnt seem like a good idea.
