SC upholds OBC quota, keeps creamy layer out

The Supreme Court on Thursday upheld a law which provides for 27 per cent reservation for Other Backward Castes (OBCs) in educational institutions supported by the Central government.

A five-judge Constitution bench headed by Chief Justice KG Balakrishnan ruled that the Central Educational Institutions (Reservation in Admission) Act, 2006, does not violate the basic structure of the Constitution.

The court ruled the 93rd Constitutional Amendment Act, which was the basis of the law providing 27 per cent reservation in aided institutions, didn’t violate the basic structure of the Constitution.

However, the court also ruled that creamy layer among the OBCs cannot get the benefit of quota. On quota in private un-aided institutions, four judges left the issue open and one judge ruled it would violate of the basic structure of the Constitution.

The 500-page verdict came on a petition by anti-quota activists challenging the Act. They had vehemently opposed government's move saying caste cannot be the starting point for identifying backward classes.

One more vote bank politics stunt. A simple analysis would show that the person below the creamy layer might not even be able to reach to the levels of an MBA institute. Assuming he does, no institute will be able to fill in all of the allocated 27 % seats to genuine quota candidates, because there arent many.

When this happens, the institute will become less vigilant and fill in the unallocated seats to any tom dick and harry who claims he is a OBC.

God knows whats going to happen to the country.

Good that creamy layer has been kept out but The quota size should have been reduced...

We cannot have reservations going on forever. Have reservations once based on poverty, set a timeline and then make it a competitive thing so you get the proverbial monkey off our country's back. You cannot ignore reservations politically nor you can bat all out for it. This would be the best bet then. It can be traced to the Mandal commission and the repurcussions can be seen even now.

Kapish. Wonder how come the brains of supposedly the best judges dont match up to the voice of a bms student.. is our political system that retarded ?? either that or BMS students are matching up with the brains of Einstein.

i think quota is a good decision only for people with poor financial status
